1What FieldWise Petition is

FieldWise Petition (“FieldWise,” “we,” “us”) is a filing-assistance software tool. We are not a law firm, not an immigration consultancy, and not a DOJ-accredited representative, and we do not provide legal advice. The platform helps agricultural employers and farm labor contractors prepare and organize H-2A petition materials (ETA-790/790A, ETA-9142A, I-129, DS-160 preparation, and related workflows).

2You are the filer

You (the “Customer”) remain the legal petitioner and signer of every filing prepared through the platform. You are responsible for the accuracy of all information you provide and for reviewing and approving every form before it is submitted to the U.S. Department of Labor (DOL), a State Workforce Agency (SWA), or U.S. Citizenship and Immigration Services (USCIS). FieldWise prepares and organizes your filing up to the point of submission; the government-facing submission is performed by you.

3No legal advice

Nothing on the platform is legal advice. Guidance, checklists, wage figures, deadline calculations, and the FieldWise Counsel (Fern) assistant are informational aids only and may not fit your situation. For legal questions, consult a qualified immigration attorney. Regulations, wage rates (AEWR), and agency procedures change; verify current requirements before relying on them.

4Accounts, credentials, and authorization

You are responsible for maintaining the confidentiality of your account. If you authorize FieldWise to access your FLAG (flag.dol.gov) or USCIS account using your stored credentials, that authorization is governed by a separate Software Assistance Authorization you sign; you may revoke it at any time. Credentials are stored encrypted (AES-256-GCM) and are used solely to prepare your filings.

5Fees and subscriptions

Access is provided on a subscription basis. Fees, billing frequency, and plan terms are presented at checkout. Except where required by law, fees are non-refundable once a subscription period has begun. We may change fees prospectively with notice.

6Acceptable use

You agree not to misuse the platform, submit false information to any government agency, upload unlawful content, or use the service to violate the H-2A program rules or any applicable law. You are responsible for compliance with all H-2A program obligations, including wage, housing, transportation, recruitment, and the three-quarters guarantee.

7Disclaimers and limitation of liability

The platform is provided “as is” without warranties of any kind. FieldWise does not guarantee approval of any filing and is not liable for government processing times, policy changes, system outages, or determinations by DOL, USCIS, SWAs, or consular officers. To the maximum extent permitted by law, FieldWise’s total liability is limited to the subscription fees you paid in the twelve months preceding the claim.

8Data retention

Petition records are retained for three years after the contract end date consistent with DOL recordkeeping requirements (20 CFR 655.167). Worker personal data used for DS-160 preparation is retained only for the active petition plus one year. Stored credentials are deleted promptly upon revocation or account closure. 9Termination

You may cancel at any time; cancellation stops future billing and does not affect filings already submitted. We may suspend or terminate access for non-payment or violation of these terms.

10Dispute resolution

These terms are governed by the laws of the State of Michigan. Any dispute will be resolved through binding arbitration in Wexford County, Michigan, except that either party may seek injunctive relief for misuse of confidential information.
